OSH Code 2020 Explained

The Occupational Safety, Health and Working Conditions (OSH) Code, 2020 is one of India’s landmark labour reforms aimed at creating safer, healthier, and more productive workplaces. Enacted by the Government of India, the Code consolidates and replaces 13 existing labour laws relating to occupational safety, health, welfare, and working conditions into a single comprehensive legislation. By streamlining multiple regulations, the Code seeks to simplify compliance for employers while strengthening the rights and protection of workers.

The primary objective of the OSH Code is to ensure that every employee works in a safe and healthy environment. It applies to various establishments, including factories, mines, plantations, construction sites, motor transport undertakings, and other industries covered under the prescribed thresholds. The Code establishes uniform standards across sectors, making workplace safety requirements more transparent and easier to implement.

A key feature of the OSH Code is the enhanced responsibility placed on employers. Every employer must provide and maintain a workplace that is free from hazards likely to cause injury, illness, or accidents. This includes ensuring safe machinery, adequate safety equipment, emergency preparedness measures, proper training, and regular maintenance of workplace infrastructure. Employers are also required to conduct risk assessments and implement preventive measures to minimize occupational hazards.

The Code gives significant importance to workers’ health and welfare. Employers must provide clean drinking water, hygienic sanitation facilities, sufficient ventilation, lighting, washing arrangements, first-aid facilities, and medical assistance where required. Certain establishments may also be required to provide canteens, restrooms, crèche facilities, and welfare officers depending on the number of employees. These provisions aim to improve overall employee well-being and workplace productivity.

Another important aspect of the OSH Code is the regulation of working hours and leave entitlements. The Code empowers the government to prescribe maximum daily and weekly working hours, overtime provisions, and rest intervals. Employees are also entitled to annual leave with wages, ensuring adequate rest and work-life balance. These provisions help prevent worker fatigue and promote healthier working conditions.

The OSH Code also introduces progressive provisions relating to women workers. Women are allowed to work in all establishments and occupations, including during night shifts, subject to their consent and the employer providing adequate safety measures. This provision supports gender equality in employment while maintaining employee safety and security.

Special attention has been given to contract labour and inter-state migrant workers. The Code simplifies registration requirements and introduces welfare measures to ensure fair treatment and social security benefits. Employers and contractors are required to maintain proper records, provide suitable working conditions, and comply with wage and welfare obligations. Migrant workers may also be eligible for benefits such as journey allowances and government welfare schemes.

To improve ease of compliance, the Code encourages digital processes for registration, licensing, maintenance of records, and filing of returns. Electronic records and online submissions reduce administrative burdens and increase transparency. The inspection system has also been modernized through the introduction of Inspector-cum-Facilitators who not only enforce compliance but also guide establishments in meeting statutory requirements.
